Narayan is a young man, who is unemployed and resides in a small village. One morning, he is informed by the Village-Pramukh that a dam is proposed to be built on a nearby river. Narayan is told that the construction of the dam would result into the employment of many young men like him and after its completion, the dam would produce hydroelectric power which will further augment the economic development of the region.

However, the very next day a village elder, who is a credential environmentalist, convenes a sabha (meeting) of all the villagers and appeals to them to protest against the planned dam.

He states that the dam would cause ecological imbalance in the region with repercussions beyond anticipation. To begin with, many species inhabiting the river would become extinct and eventually this entire region would become vulnerable to natural disasters. Thus, he is of the view that dam is not going to bring any economic boon rather it is going to be like a bane.

Case Study: 1

The leader of a prominent social group has been facing trial in a criminal case. The court is expected to deliver the verdict in two days. Ahead of the verdict, a large number of members of this group from various parts of State have flocked en masse to the city where the court is located. They threaten to go on a rampage if their leader is convicted and jailed. They have started camping in the city, along many roads and in various public parks. There are reports that the followers may be stocking up on arms, petrol and blunt weapons. The rampage threatens to spill into the neighboring States also. 

You are the Chief Secretary of the State.

  1. What are the measures you will take to ensure that there is no disruption of public order, regardless of the verdict?
  2. What intervention would you consider to prevent any similar mass hysteria in the future? (300 words / 25 marks)

Case Study: 2

You are posted as a young ASP in a backward rural district after training and you are in high spirits to serve the nation. You see that the field officials are corrupt in your jurisdiction; one particular Thana under you has a Thanedar with a bad reputation. He is deemed notorious in his official dealings by the locals and does not provide you a Daily Situation Report (salamati), upon being asked he says that he thinks it fit only to notify about unusual occurrences. While he is encouraging you to visit his area for site seeing but makes spurious excuses of being busy in a protocol when you insist on Thana inspection. There are serious complaints about his links with feudal setup in the rural area who try to control the resources of the area by muscle power and exploit the poor. Upon being asked about the state of affairs and his involvement he narrates a story about caste politics in the village as the systemic root of the problem. When you initiate an inquiry against rural strongmen he informally informs the SP whom you suspect also to have vested interest in the feudal nexus. Taking cognizance of complaints against the Thanedar you conduct an inquiry against him and finalize a report and present evidence to suggest that the integrity of the Thanedar is compromised. Though the report cannot result in a suspension or a disciplinary chargesheet, it can be a basis for his transfer. The SP does not stop you from conducting inquiry initially but upon presentation of the report rejects its recommendations citing trivial procedural errors. By this time you also realize that the local MP/ MLA are under influence of the feudal strongmen for electoral benefits.

Critically evaluate the options that are available with the ASP in the above mentioned situation. (250 Words, 20 marks)

(a) Mr P is a public servant. He charges a bribe for every work that he takes up. Explain why this behavior is unethical?

(b) Mr Q is a public servant. He charges a bribe for quick disposal of files. He argues that he is efficient at his work and the government does not pay him enough. Is his argument ethical? Give reasons for your answer.

(c) Mr R is a public servant. He does not ask for any bribe on his own, but does accept it if it is offered. How different is the conduct of Mr. R from that of Mr. P? Can Mr R be termed as partially ethical ?

(d) Mr S is a civil servant. He does not take bribe. If anyone offers him he politely declines them. However, he does not discourage his colleagues or subordinates from taking any bribe. Do you see any ethical deficiency in the conduct of Mr. S? (250 words / 20 marks)
